1. About these terms
These Terms & Conditions govern use of the Enfinite Smart School website and school management software provided by Enfinite Software Solutions ("we", "us", or "our"). By using the service, you agree to these terms to the extent applicable to your use. If you act for a school or another organization, you must have authority to do so.
A separately agreed school contract or subscription order takes precedence where it conflicts with these general terms. Nothing here overrides rights or protections that cannot lawfully be excluded.
2. Software usage
You may use the features made available under your school's account, assigned role, and subscription for legitimate school administration and related educational activities. Access is limited to authorized users and the scope of the applicable service agreement. Students and other users requiring supervision must use the service with the appropriate school or parent or guardian authorization.
3. Account responsibility
Provide accurate account details, safeguard login credentials, and notify us promptly about suspected unauthorized access. School administrators are responsible for assigning suitable access, reviewing user permissions, and removing access when a person no longer needs it. Do not share credentials or use another person's account without authorization.
You are responsible for the information and instructions you submit and for checking important records before relying on them for school decisions.
4. Subscriptions and renewals
Features, usage limits, subscription periods, trial arrangements, and support entitlements are those stated in your accepted order or service agreement. Renewal, cancellation, and any changes to the subscription are governed by those agreed terms. Contact us before the end of a subscription if you need to confirm renewal or cancellation arrangements.
These general terms do not create an automatic renewal obligation or promise access to features outside your subscribed plan.
5. Payments and billing
Pay the fees, applicable taxes, and charges stated in your accepted order or invoice by the agreed due date. Notify us of billing discrepancies so they can be reviewed. Refunds, credits, and cancellation charges, if any, follow the applicable agreement and mandatory legal requirements.
School fees recorded or collected using the software are distinct from the school's software subscription. The school determines its own educational fees and related refund policies. Where a third-party payment provider is used, its processing terms also apply.
6. Acceptable use
- Do not upload unlawful, abusive, misleading, or infringing material, or disclose personal information without appropriate authority.
- Do not attempt to bypass access controls, access another school's records, introduce malware, or disrupt the service.
- Do not use the service for spam, unauthorized surveillance, or activities unrelated to your permitted access.
- Do not copy, resell, or reverse engineer the software except where expressly permitted by an agreement or applicable law.
7. Data ownership and privacy
Schools and other rightful owners retain their rights in information they submit. Using the service does not transfer ownership of school or student records to us. You authorize us to process that information as necessary to deliver and support the service under the applicable agreement.
The school is responsible for the accuracy and lawful collection of its records, required notices and authorizations, and its instructions to users. Our handling of personal information is described in the Privacy Policy. Contact us about available export or return arrangements before ending service.
8. Service availability
The service may be interrupted by maintenance, updates, network problems, third-party outages, or events outside reasonable control. Features can be updated over time. Any specific uptime, backup, support-response, or service-level commitment must be stated in the applicable agreement; these terms do not promise uninterrupted or error-free operation.
Schools should maintain appropriate operational procedures for important activities when the service is unavailable.
9. Intellectual property
The software, website design, branding, and related materials remain the property of their respective owners or licensors. Your access permits use of the service within the agreed scope and does not transfer intellectual property rights. School-provided content remains subject to the data ownership provisions above.
10. Limitation of liability
To the extent permitted by applicable law and subject to a separate agreement, we are not liable for indirect or consequential losses arising from use of the service, such as loss of anticipated profits or business opportunities. Responsibility for direct losses and any agreed liability limits is governed by the applicable service agreement and law.
Nothing in these terms excludes liability that cannot lawfully be excluded, or removes mandatory consumer or data-protection rights. Users remain responsible for their own unauthorized actions and for verifying information they enter or use.
11. Suspension and termination
Access may be restricted or suspended where necessary to address security risks, unlawful use, material breaches, or unpaid amounts, subject to the applicable agreement and legal requirements. Cancellation or termination otherwise follows your service agreement. Where practicable and appropriate, notice and an opportunity to resolve a problem will be provided.
After access ends, contact the school administrator or our support team about available data-return arrangements. Retention and deletion remain subject to the Privacy Policy, contractual obligations, and applicable law.
12. Changes and applicable law
Updates to these terms will be shown with a revised last updated date. Material changes are subject to any notice or acceptance requirements in the applicable agreement or law. Governing law and dispute arrangements stated in a separately agreed contract continue to apply, subject to mandatory legal protections. Please contact us first to discuss a service concern.
